Contumaz

Contumaz, juristisch, bedeutet ein Versäumniß, einen Ungehorsam. Sie muß von dem Gegner angeschuldigt werden, und der Versäumende wird denn, wenn die übrigen Erfordernisse da sind, in contumaciam verurtheilt, d. h. er verliert dasjenige, was er durch seinen Ungehorsam verwirkt hat. Wenn z. B. Jemand auf eine erhobene Klage binnen der gesetzlichen Frist nicht antwortet, so wird er derselben für geständig geachtet und man nennt seine Verurtheilung in contumaciam, weil er sie seiner Versäumniß zuzuschreiben hat Im politischen Sinne heißt Contumaz die Sicherung eines Landes vor ansteckenden Krankheiten, namentlich vor der Pest, daher Contumaz- oder Quarantaineanstalten, wo Personen, die aus angesteckten oder verdächtigen Gegenden kommen, eine Zeit lang, bei der Pest gewöhnlich 40 Tage, daher Quarantaine s. d. A., festgehalten werden.
